This article explores the affective dimension of resilient epistemological systems. Specifically, I argue that responsible epistemic practice requires affective engagement with nondominant experiences. To begin, I outline Kristie Dotson's account of epistemological resilience whereby an epistemological system remains stable despite counterevidence or attempts to alter it. Then, I develop an account of affective numbness. As I argue, affective numbness can promote epistemological resilience in at least two ways. First, it can reinforce harmful stereotypes even after these stereotypes have been rationally (...) demystified. To illustrate, I examine the stereotype of Black criminality as it relates to false confessions. Second, it can encourage “epistemic appropriation”, which I demonstrate by examining the appropriation of “intersectionality” and #MeToo by white culture. Finally, I conclude that resisting harmful resilience requires affective resistance, or efforts that target numbness via different kinds of affective engagement. In order to address questions about how to conceptualize and resist epistemic oppression most effectively, this essay develops a critical engagement with Kristie Dotson’s “Conceptualizing Epistemic Oppression.” Relying on a conceptual clarification of what is meant by “shared epistemic resources,” I argue against Dotson’s distinction which finds some instances of epistemic oppression to be “reducible” to the unequal distribution of social and political power, and some to be distinctively epistemic, and thus “irreducible” to these factors. Rather, I maintain the most (...) effective conceptualization of the phenomenon will find that all of its forms have a distinctive epistemic dimension that must be contended with; they are thus irreducible in Dotson’s sense. In other words, the critical interrogation of governing norms will be necessary for resistance in all three cases. This paper presents an analysis of the opinions of U.K. Finance Directors – also known as Chief Financial Officers (CFOs) in North America – on factors which may effect the roles and responsibilities of the external auditor to the organization. A number of proposals have been put forward over the years to enhance auditor independence and these were treated as dependent variables in this study. A questionnaire was mailed to 3 000 named Finance Directors and 776 useable replies were received. (...) From the responses to the questionnaire, three independent variables were identified: opinions on the value of the audit in general; opinions on the impact of the audit on the organization; and the relationship between the Finance Director and the auditor. The results reveal that those Finance Directors concerned in general about the value of auditing favoured the banning of non-audit work and the rotation of auditors. In addition, those Finance Directors with good relationships with their external auditors preferred the banning of non-audit services and the rotation of external auditors. Those respondents favouring the separate regulation of auditors were also concerned about the impact of the audit on the organization. The results of this study shed some light on the sensitivity of U.K. Finance Directors to ethical issues regarding external auditor independence. (shrink)

Spice is also peppered throughout the Old Testament.2 The Song of Solomon recites: “Thy plants are an orchard of pomegranates, with pleasant fruits; camphire, with spikearion 28.1 spring/summer 2020 2 a vexed pharmacopeia nard and saffron; calamus and cinnamon, with all trees of frankincense; myrrh and aloes, with all the chief spices.”3 Every one of these fruits, plants and spices remained popular in the West throughout antiquity, into the Middle Ages, and beyond. As early as 3000 bc, trade routes had connected the Mediterranean to the near east. Courtesy of this “Spice Road,” ancient Mediterranean civilizations had access to a wide range of horseradishes, mustards, peppers, gingers and other spices. The Greeks and Romans had a special relationship with black pepper—so much so that four out of five recipes in Apicius’s famous 1st century cookbook4 called for a sprinkling of this sometimes-costly commodity. It is perhaps not coincidental that black pepper contains heat-producing alkaloids very similar to those found in New World chili peppers. Much has been written about the important role of chilis in South and Central American culture—a region that, by the Middle Ages, was in many respects the equal of Europe in “artistic sensibility, social complexity, and political organization.”5 The habanero and its capsainoid cousins were at the heart of the culinary and ceremonial customs of Mesoamerica, their biting heat and florid livery an apt metaphor for the “extravagant feats of human butchery”6 —very much in the tradition of the spectacular venationes of ancient Rome—for which the Aztecs at least were well known. At a conference hosted by the Institute for Digital Archaeology at the University of Oxford last December, experts from Europe and North America examined the literary, historical, archaeological and scientific evidence around these questions. Their inquiry received a boost from new and rapidly developing techniques for examining the physical evidence of ancient diet and food production—laboratory techniques not available even five years ago. There was also fresh medical evidence to consider: significant research is being done in the area of chemosensation in the context of spicy foods. This Roger Michel, Alexy Karenowska, George Altshuler, Matthew Cobb 3 includes trying to understand how different so-called “TRP channels” in the nervous system process spice information— in particular, the connection between spice and endorphin levels. It appears that many of the hot spices available in antiquity could potentially trigger the same TRP channels as the capsaicin-charged Mesoamerican peppers. This creates a nice connection between old and new world spice that helps to explain and contextualize both. However, in the end, firm conclusions at the Oxford conference were scarce. It quickly became clear that more work, a greater diversity of viewpoints, better refined questions, and a change of venue were required to make additional progress. Softlifting, or the illegal duplication of copyrighted software by individuals for personal use, is a serious and costly problem for software developers and distributors. Understanding the factors that determine attitude toward softlifting is important in order to ascertain what motivates individuals to engage in the behavior. We examine a number of factors, including personal moral obligation (PMO), perceived usefulness, and awareness of the laws and regulations governing software acquisition and use, along with facets of personal self-identity that may play a (...) role in the development of attitudes and therefore intentions regarding this behavior. These factors are examined across multiple settings expected to be pertinent to our survey respondents: home, work and school. Personal moral obligation and perceived usefulness are significant predictors of attitude across all settings. Past behavior is a significant predictor of intention across all settings, and a significant predictor of attitude in the home setting. We find evidence that awareness of the law causes a less favorable evaluation of softlifting in the school setting only, but has little effect in the home and work settings. As in previous studies, attitude is a significant predictor of intent. We do not find indications that one’s personal self-identity influences one’s attitude towards the behavior and the intention to perform it, except in the case of legal identity, where marginally significant effects are found in the work environment. The Association of Research Ethics Committees is one of the leading providers of training and education for members of Research Ethics Committees. The introduction of the research governance strategy and the increasing complexity of ethical review place great demands on research ethics committee members that in turn creates challenges for training providers. This paper presents the outcome of an audit of REC members' views about training. Findings demonstrate that REC members are not a homogenous group. In Oneself as Another, Ricœur famously writes of the ethical intention as “aiming at the ‘good life’ with and for others, in just institutions.” This article explores the potential meaning of “just institutions,” a theme underdeveloped in Ricœur’s work. While many have argued that institutions necessarily reify and so cannot aim toward just ends, the article draws on Ricœur’s differentiation between objectification and reification to show why this need not be the case. While reification destroys human value and meaning because (...) it reduces human activity to a thing, objectification characterizes the positive externalization of ourselves in objects—in words, deeds, structures, and institutions. Institutions such as the law are structures that can positively objectify our just aspirations, even if we must continually guard against these structures’ reified reduction. Ricœur shows us how objectification, including objectification of values in institutions, can be something not only positive but necessary in order for values to flourish. (shrink)

Even if contemporary liberal political thought fails to provide an adequate basis for environmental protection, investigating its environmental implications may be a worthy enterprise, if only to foster discussion among liberal thinkers about the obligation to protect the environment. Examination of four contemporary liberal views of distributive justice?those of Rawls, Arneson, Sen, and the libertarians?shows that in these theories, environmental protection turns either on obligations to future generations or on the rights of individuals. Spanning some twenty-five years of work, an intriguing study of the photography of Charles Lutwidge Dogson presents a rich array of more than 450 images that capture diverse facets of Victorian society, his relationship with the children he photographed, portraits of famous personalities of the time, narrative tableaux, and bizarre studies of anatomical skeletons.

It is a common metaphor that the text is a window onto the world that it depicts. I want to explore this metaphor and the insights it may offer us for better understanding legal interpretation. As in the opening epigraph from James Boyd White, I shall develop the metaphor of the text as window in three ways: the text may be transparent, opaque, or translucent. My goal will be to argue that the best way to understand legal interpretation is to (...) conceive of the legal text as translucent, but along the way I will compare the merits also of considering the legal text as either transparent or opaque. This article attempts to show the continuing practical relevance of hermeneutics through the example of legal interpretation. The article begins with the very concrete nature of legal hermeneutics that forms everyday legal practice – the interrelation of meaning and application – and expands at a more theoretical to show how legal hermeneutics, and hermeneutics more generally, offers what Ricoeur calls an interpretive “choice in favor of meaning.” The choice in favour of meaning underscores the restorative character of hermeneutics that legal (...) hermeneutics can epitomize. As Ricœur scholars know, the literature by and on Ricœur is vast. Material written by Ricœur that is not collected in published volumes is often difficult to locate, and even in the published volumes it is frequently a challenge to locate where Ricœur discusses a particular topic. Given the amount of his work it can be a challenge too to determine changes in his analyses over the life of his corpus. And locating secondary literature on Ricœur can be equally problematic. (...) In response, we have been working to establish a model for how Ricœur’s corpus might be digitized so that the issues of access, keyword location, and pattern might all be addressed. To develop the model, we are starting with Ricœur’s primary texts in English and plan to expand over time to other languages and to the secondary literature on Ricœur. In the present article we discuss our model and its five steps: digital access; copyright; text preparation for digital searches and analysis; examples of digital searches and analyses; and an archive portal interface that allows users to query based on an extensible set of search variables without needing to know or access the underlying search logic. Hermeneutics encounters three current challenges: by more quantitative orientations, by stances that reject pluralism, and by criticism that the hermeneutic field is elitist and esoteric. The article offers a response through Ricœur. The hermeneutic “choice in favor of meaning” insists upon the ontological value of the human condition. It shows the insufficiency of the quantitative approach, the remaining value of pluralistic consideration of what human meaning entails, and the real world consequences of interpretation. Examples in Ricœur show how a hermeneutic (...) choice in favor of meaning is not passive but instead reads texts with a particular orientation even when the text seems engaged in another project. The article’s final part undertakes an internal critique, raising the adequacy of Ricœur’s emphasis on meaning as an affirmation of “being.” The example of Buddhist insistence on “emptiness” is offered as one counterexample. The article concludes by arguing that in our contentious times hermeneutics confirms its contemporary vitality through its choice in favor of meaning even as it retains pluralistic consideration of what that meaning entails. This article elaborates the continuing significance of Ricoeur’s development of utopia. Ricoeur develops two not necessarily exclusive aspects of the utopia in its positive sense. First, it acts as an imaginative variation on existing reality, and second, it can act to ‘shatter’ and hence recast existing reality. While Ricoeur himself did not tend to distinguish rigorously between these two senses of the utopia, the article seeks to provide that delineation. Imaginative variation opens the sphere of human possibility but remains hypothetical, (...) while the utopia as that which shatters can introduce a new reality into social existence. In the utopia that shatters, the social imagination can be constitutive of social life. The article situates Ricoeur’s discussion of utopia in his Lectures on Ideology and Utopia in relation to other relevant texts in his corpus, principally The Rule of Metaphor and the forthcoming Lectures on Imagination. The argument locates Ricoeur’s treatment of utopia within the broader field of his work on the symbolic structure of action and social imagination. (shrink)
